The income tax is constitutional. However that does not mean the tax is imposed on your right to earn a living. Depending on the nature of the activity you are engaged in to earn your living in. The tax may or may not apply. The only question here is whether or not there is a clearly laid provision of statutory “liability” that applies to you. All taxes share 3 elements. 1. What is taxed. 2. How much tax. and 3. Who is “LIABLE” for the tax. All 3 elements must be there for the tax to be valid.
Income taxes and “employment” taxes are two separate species of tax. “Employment” taxes involve participation in Federal Entitlement programs such as Old-age, survivors, and disability insurance and are “voluntary”. These taxes are imposed in subtitle C of title 26. Not subtitle A. You may wish to use your computer to research 20 CFR 404.1001 et seq. for definitions. § 3102. § 3202. and § 3403 make the employer “liable” for Subtitle C taxes. Not the employee.

There is a problem with your ‘solution’. When your payer has a w-2 on file, the government assumes your earnings are wages and taxable income. So, you are then legally required to file a 1040 because it is already assumed you are a person required to file.
Instead, correct your information with the IRS, stating that it was a non-taxable activity.

To stop paying simply file exempt and tell your employer that you will owe nothing at the end of the year because of your many deductions. Tell them you have it all worked out with tax professionals and that it’s perfectly legal.
